LekkerLivings respects privacy and processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable South African law.

1. Responsible party and Information Officer

LekkerLivings is a trading name used by Jan Adriaan Hendrik van den Berg, a South African sole proprietor. The proprietor is the responsible party and Information Officer for personal information processed by the business.

2. Information we may collect

  • Names, delivery and billing addresses, telephone numbers and email addresses.
  • Order details, selected products, transaction amounts, refunds and customer-service correspondence.
  • Limited payment status and transaction references supplied by Yoco or another authorised payment provider. LekkerLivings does not receive a customer's complete card number or card security code.
  • Account details where a customer creates a Shopify customer account.
  • Product reviews, star ratings, photographs or videos voluntarily submitted through Judge.me.
  • Technical information such as IP address, device and browser information, cookie identifiers, website activity and security logs.
  • Marketing preferences and records of consent, objections or unsubscribe requests.

3. Why we process personal information

We process information to:

  • provide products, process orders and deliver parcels;
  • process payments, refunds and fraud-prevention checks;
  • communicate order, delivery, return and support information;
  • meet accounting, tax, consumer-protection and legal obligations;
  • maintain website security, prevent misuse and improve store performance;
  • display and moderate genuine product reviews;
  • send marketing only where permitted and manage opt-out requests; and
  • establish, exercise or defend legal rights.

4. Sources of information

Information is collected directly from customers, from their interaction with the website, and from service providers involved in checkout, payment, delivery, fraud prevention, reviews and customer support.

5. Sharing information

We disclose only the information reasonably necessary for the relevant purpose. Recipients may include:

  • Shopify, which hosts and operates the online store;
  • Yoco and participating banks or payment networks, which process payments and refunds;
  • delivery and logistics providers, which require recipient and address details;
  • Judge.me, which collects and displays product reviews;
  • professional advisers, accountants, insurers or technology providers under appropriate confidentiality obligations; and
  • regulators, law-enforcement bodies, courts or other parties where disclosure is required or permitted by law.

We do not sell personal information.

6. Cross-border processing

Shopify, Yoco, Judge.me and other technology providers may store or process information outside South Africa. Where personal information is transferred across borders, we take reasonable steps to use providers and safeguards consistent with section 72 of POPIA and applicable contractual requirements.

7. Retention

Personal information is retained only for as long as reasonably required for the purpose for which it was collected, to complete transactions, resolve disputes, prevent fraud and comply with legal, accounting and record-keeping duties. When information is no longer required, it will be deleted, destroyed or de-identified where reasonably practicable.

8. Security

We use reasonable technical and organisational safeguards appropriate to the nature of the information, including reputable hosted systems, access controls, secure payment processing and reasonable account and device security. No online system can be guaranteed completely secure.

If a security compromise creates a legal notification obligation, we will notify the Information Regulator and affected data subjects as required by POPIA.

9. Customer rights

Subject to POPIA and PAIA, a person may request confirmation that we hold their information, request access, ask for correction or deletion of inaccurate or unlawfully retained information, object to certain processing, withdraw consent where processing depends on consent, or request that direct marketing stops.

Requests must be sent to support@lekkerlivings.co.za. We may reasonably verify the requester's identity before acting.

10. Marketing communications

Joining the “Lekker list” is optional. Where consent is required, marketing will be sent only after valid consent. Existing customers may receive marketing for similar products where law permits, provided they were given a clear opportunity to opt out.

Every electronic marketing message will provide a reasonably accessible unsubscribe method. An unsubscribe request will be honoured without charging a fee.

11. Cookies

The website uses necessary cookies for functions such as navigation, cart contents, checkout, security and customer accounts. With the customer's choice where required, analytics or marketing cookies may also be used to understand store performance or measure advertising.

Customers can use the website's privacy controls or browser settings to manage non-essential cookies. Blocking necessary cookies may prevent cart, account or checkout functions from working correctly.

12. Children

The store is intended for adult purchasers. We do not knowingly use children's personal information for direct marketing. A parent or guardian who believes that a child supplied personal information without appropriate authority should contact us.

13. Complaints

Please contact us first so that we can investigate. A person may also lodge a POPIA complaint with the Information Regulator through inforegulator.org.za/complaints or contact the Regulator on 010 023 5200.

14. Updates

We may update this policy to reflect changes to the law, our services or our service providers. The latest version will be posted on the website with its revision date.
