1. Supplier information

LekkerLivings is a trading name used by Jan Adriaan Hendrik van den Berg, a sole proprietor operating in South Africa.

2. Application and acceptance

These Terms apply to use of the LekkerLivings website and purchases made from it. By placing an order, the customer confirms that they have reviewed the order, supplied accurate information and accepted these Terms together with the applicable Refund, Privacy and Shipping policies.

Nothing in these Terms excludes or restricts a customer's non-excludable rights under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA) or another applicable law.

3. Products and information

We take reasonable care to describe and display products accurately. Colours and scale may vary slightly because of lighting, screens or photography. Dimensions, quantities, included components, fragrance selections and compatibility stated on the product page form part of the product description.

Customers must read and follow the supplied product instructions and warnings. Electrical cleaning equipment must be charged, assembled, stored and used only as directed. Cleaning products and attachments must be kept away from children and pets and must not be used or mixed in an unsafe manner.

4. Prices and VAT

Prices are displayed in South African rand (ZAR). LekkerLivings is not registered for VAT and does not charge VAT. Delivery charges and any applicable discount are displayed separately at checkout before the customer places the order.

If a price is displayed incorrectly because of an obvious technical or typographical error, we may contact the customer before fulfilment to correct or cancel the order. This clause will not be applied in a manner inconsistent with the CPA.

5. Orders and stock availability

An order is submitted when the customer completes checkout. An automated acknowledgement confirms receipt of the order; fulfilment remains subject to successful payment verification, product availability and fraud-prevention checks.

Stock is held by LekkerLivings, but an inventory error may occasionally occur. If we cannot supply an ordered item, we will notify the customer promptly and provide a refund or another remedy agreed with the customer.

6. Payment policy

Online payments are processed securely through Yoco. The payment methods currently available are displayed at checkout. LekkerLivings does not receive or store a customer's complete card number or card security code.

The customer authorises the payment provider to process the amount shown at checkout. An order will not be dispatched until payment has been successfully confirmed. If a payment is declined, reversed or flagged for lawful verification, we may place the order on hold and contact the customer.

7. Order review and correction

Before placing an order, the customer can review the selected products, variants, quantities, delivery method, delivery charge, discounts and total price and can correct mistakes or leave checkout. After ordering, the customer should contact us immediately if an error is discovered.

8. Cancellation policy

A customer may request cancellation before dispatch by emailing support@lekkerlivings.co.za with the order number. If cancellation is completed before dispatch, the amount paid for the cancelled order will be refunded.

If the parcel has already been dispatched, cancellation will be handled under the Refund, Returns and Exchanges Policy and the customer's statutory cooling-off rights. The customer may then be responsible for the direct return-delivery cost where permitted by law.

LekkerLivings may cancel an order if payment cannot be verified, the product is unavailable, the order appears fraudulent, fulfilment would be unlawful or a material pricing error cannot reasonably be resolved. Where the customer is not at fault, amounts paid for the cancelled goods will be refunded.

9. Shipping and delivery

Delivery methods, charges and estimated periods are set out in the Shipping and Delivery Policy and displayed at checkout. Risk and delivery obligations are governed by applicable South African law. A delivery estimate is not a waiver of the customer's rights if LekkerLivings fails to deliver within the agreed or legally required period.

10. Returns, refunds and warranties

The Refund, Returns and Exchanges Policy forms part of these Terms. It includes the applicable ECTA cooling-off period, LekkerLivings' additional 14-day change-of-mind policy and the CPA implied warranty of quality for defective goods.

11. Bundles, promotions and discounts

Bundle contents, variant choices and prices are shown on the relevant product page. Discounts have no cash value and cannot be combined unless the promotion expressly allows it. A returned bundle must ordinarily be complete for a voluntary change-of-mind return. Statutory rights for defective or incorrectly supplied components remain unaffected.

12. Reviews and customer content

Product reviews may be collected and displayed through Judge.me. A reviewer must provide an honest account of their experience and must not submit unlawful, abusive, misleading or infringing content. We may moderate content for legality, privacy and relevance, but will not fabricate reviews or alter a genuine review merely because it is negative.

13. Intellectual property

The LekkerLivings name, logos, product images, written content, graphics and website design are owned by or licensed to LekkerLivings. They may not be copied, republished, sold or commercially exploited without prior written permission, except where the law permits.

14. Acceptable website use

A user may not interfere with the website, introduce malicious code, attempt unauthorised access, misuse checkout, scrape the website at an unreasonable rate, commit fraud or use the website for an unlawful purpose.

15. Liability

LekkerLivings will be responsible where required by applicable law. No clause in these Terms excludes liability that cannot lawfully be excluded, including applicable liability for unsafe or defective goods. To the extent permitted by law, LekkerLivings is not responsible for loss caused solely by misuse contrary to instructions, unauthorised alteration, an incorrect address supplied by the customer or an event genuinely beyond reasonable control.

16. Privacy and security

Personal information is processed as described in the Privacy Policy and in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Shopify, Yoco, Judge.me and delivery providers may process information necessary to operate the store, complete payments, deliver orders and collect genuine reviews.

17. Electronic records

Customers receive an electronic order confirmation and can retain these Terms and policies by saving or printing them. Order records can be requested by contacting us, subject to identity verification, POPIA, PAIA and applicable retention requirements.

18. Complaints and dispute resolution

Please first submit a complaint to support@lekkerlivings.co.za with the order number, facts and requested resolution. We will acknowledge and investigate the complaint in good faith.

If a consumer dispute cannot be resolved directly, the customer may approach the Consumer Goods and Services Ombud (CGSO) at www.cgso.org.za or 0860 000 272, or submit an eligible complaint to the National Consumer Commission at thencc.org.za/complaints. Privacy complaints may be submitted to the Information Regulator at inforegulator.org.za/complaints.

19. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with by a competent South African court, tribunal, ombud or regulatory body, subject to the consumer's statutory rights.

20. Changes to these Terms

We may update these Terms prospectively to reflect legal, operational or service changes. The version applying to an order is the version available when that order was placed, unless the law requires otherwise.
